We also collect intake form responses, appointment scheduling details, and payment information processed through our secure payment provider.

Your information is used to provide clinical services, schedule appointments, process payments, communicate with you about your care, send appointment reminders, and fulfill legal and regulatory obligations. We do not sell your personal information or PHI to third parties.

4. How we protect your information

We implement appropriate administrative, technical, and physical safeguards to protect your information. All data is encrypted in transit using TLS and at rest using AES-256 encryption. Access to PHI is restricted to authorized clinical and administrative personnel on a need-to-know basis. We maintain Business Associate Agreements (BAAs) with all service providers who may access PHI, including our cloud hosting, database, email, and document storage providers.

5. Third-party services

We use the following categories of service providers to deliver our services: cloud hosting and application infrastructure, secure database storage, email communication services, payment processing, video conferencing for telehealth sessions, and document storage. Each provider is selected for its security practices and, where applicable, maintains HIPAA compliance certifications.

6. Your rights

7. Cookies and analytics

We retain clinical records in accordance with applicable federal and state laws, which generally require retention for a minimum of seven years from the date of last service, or longer if required by the jurisdiction in which services were provided. Payment records are retained as required by tax and financial regulations.

9. Children's privacy

We provide services to minors with the consent of their parent or legal guardian. Personal information of minors is collected and managed with the same protections as adult patient information, with additional safeguards as required by law.

Services are delivered by licensed psychologists and mental health professionals through secure telehealth platforms. Our services are designed for international families, expatriates, and professionals across Asia.

3. Eligibility

You must be at least 18 years of age to create an account or book services. Services for minors require the consent and involvement of a parent or legal guardian. By booking an appointment, you represent that you have the legal authority to consent to treatment for yourself or the individual for whom you are booking.

4. Appointments and cancellations

Appointments are confirmed upon receipt of payment. We require at least 24 hours' notice for cancellations or rescheduling. Late cancellations or no-shows may be subject to a cancellation fee equal to the full session rate. We reserve the right to modify our cancellation policy with reasonable notice.

5. Payments and fees

Payment is required at the time of booking unless otherwise arranged. We accept payment through PayPal and other approved payment methods. A 3% processing fee applies to PayPal transactions. All fees are listed in US dollars unless otherwise specified. Refunds are handled on a case-by-case basis in accordance with our cancellation policy.

6. Telehealth consent

By using our Services, you consent to receiving healthcare services via telehealth technology. You understand that telehealth involves the use of electronic communications to enable healthcare providers to deliver services remotely. You acknowledge that telehealth has limitations, including the inability to perform physical examinations, and that technical difficulties may occasionally disrupt sessions.

7. Confidentiality

We maintain the confidentiality of your personal and clinical information in accordance with HIPAA, applicable state laws, and professional ethical standards. Information may be disclosed as required by law, including mandatory reporting obligations related to the safety of minors or individuals at risk of harm.

8. Intellectual property

All content on the Eureka Behavioral Health website, including text, graphics, logos, and software, is the property of Eureka Behavioral Health and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written permission.

9. Limitation of liability

To the fullest extent permitted by law, Eureka Behavioral Health shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our Services.
